Legal Question in Family Law in New Jersey

Alimony

When I reach retirement age, possibly 62, if my divorce decree states that I pay Alimony for lifetime, will I have to continue to pay even though I will only have Social Security?

Thank you for your inquiry.

Upon your retirement, a post-judgement motion must be filed on your behalf seeking to either reduce or terminate alimony.

As it would be my pleasure to speak to you regarding your situation, please feel free to contact my office at 732 246 0909 to discuss same.

Very truly yours,

Re: Alimony

Retirement is considered a change in circumstances warranting review and potentially modification of alimony in New Jersey. However, early retirement doesn't necessarily guarantee a reduction or even review of support. If you would like to further discuss this matter, please feel free to contact my secretary, Debbie, to schedule a consultation. 856-795-6700.

Re: Alimony

A substantial change in your income is sufficient basis for you to apply to reduce the amount of alimony you pay or even the elimination of alimony payments by you. Permanent alimony was premised on your earnings when the judgment of divorce was entered. You should call me at 800 273 7933 to discuss your question further.
