For a full answer to this question, please take a look at the FAQ section under "Questions and Answers" for Family and Divorce Law under the Law Guru Tools on the tool bar to the left of the screen on the main page. However, in brief, the right to receive alimony is based on a number of statutory factors including life style of the parties and the ability of the paying spouse to afford payments to the non-paying spouse. The statute is gender neutral, so that if the Wife, for example makes $100,000 per year and has supported the Husband, who stays at home with kids and has done so during the course of the marriage, it is likely that Wife will pay Husband alimony. Caution - this is only an example to make my point. A careful analysis needs to be made of the factual scenario before an alimony decision is made. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner
