alimony/change in circumstances
my husand, 63 years old & now is collecting ss of $1500.00 per month. He owes her back ''alimony'' of $145,000. The Alimony order by Summerset Cty in NJ of $3000.00 per month. NJ courts threatened to arrest him for failure to pay. We filed BK in GA 3 years ago, no savings or other income, other than mine $35,000. annually and his ss. His X-wife was given half of asset when divorced ('92) approx. 3/4 of million, plus purchased home for her, and $60,000. in child/alimony until approx 2002. Child is now 30 and married. X-wife does not work and will not work (64). NJ state is going to arrest him if he misses two alimony payments. We have no money for attorney fess, etc..and need advise on where to go from here, or what do do. Do we need to file for change in circumstances/and how to do that without an attorney or funds to do so?? Please rely asap! THANK YOU SO MUCH!

To file a motion, just call the court and tell them what you want to do. They should be able to send you the forms you need.
Otherwise, I fail to see how anyone on this site can give you the information that you need. Such a motion is very difficult, even if you have an attorney. My suggestion is that you get a credit card if you can or borrow some money from other people and hire an attorney.

You need to file with the Court for relief from the alimony requirement based on a significant and involuntary
change of financial circumstances. You need an attorney to do this effectively. I would charge a very reasonable fee for this service.
