Allienation of affection

Can I sue the mistress of my husband for Allienation of affections/phychological suffering? I live in NJ, she in Fl, I have proof they had sex in TX, NV, & NJ. Are any similar laws still effect in any of these states? Statute of limitations?

Do I need to be divorced from him to do it?

Your toughest problem here may be finding an attorney that would take such a case. In my opinion, you should just file for divorce if the marriage is really over.
