I am not sure whether you are asking about what the standards are to get your alimony discontinued or whether you know you are entitled to have it stopped and you want to know the logistics of getting it stopped. If you know you are entitled to have it stopped, then you need to get your spouse to sign something to indicate his/her consent and then get an Order entered to confirm this with the Courts. You could probably accomplish this yourself with the assistance of the Family Intake Unit at your county Courthouse. Or, you could file a motion asking a Court to enter the Order, based on facts that you will put into an Affidavit. If, on the other hand, you are asking about the standards, there are many. To determine your right to discontinue alimony payments, first an attorney would want to review your Final Judgment of Divorce and Property Settlement Agreement or applicable Court Order. Then, a review of your circumstances would be in order to determine whether you are entitled to stop payments. No one, however, can rely on advice from an attorney who has not been retained.
