Legal Question in Family Law in New Jersey

My ex applied for a TRO, and a hearing was scheduled for 11/15. I did not receive notice of same until after that date because I was on vacation. I have heard nothing since then. If the hearing was held and an FRO was entered, wouldn't they have contacted me by now to advise me of the penalties? For the record - the source of the request was trivial e-mail traffic and involved no threats or violence.

I am somewhat surprised to hear that you did not call the court to learn what happened in your absence. What should have happen is the rescheduling of the case until there was proof that you received service of the papers. I would suggest that you call the court to learn what happened. A final restraining order based upon a finding of domestic violence is inputed into a special domestic violence registry and when you are stopped by the police or you are checked at the airport it will come up and may cause you to be viewed as having violence propensities.

Call me if you like.

Please keep in mind that my response is just a general comment on your question, and not legal advice. I have answered based upon the law of the State of New Jersey where I practice; the laws in other states may be very different, and may result in very different outcomes. Your question and any response does NOT create an attorney-client relationship between you and this law firm. The exact details of your situation and things that you have not mentioned in your question can completely change the response I gave. You can not rely upon what I have written as legal advice, because I do not have all of the information that I need to advise you, I only have the very small amount of information that you put into your question. To get legal advice that you can rely on and use, please contact me directly.
