Back Money
My husband is a police officer. We have been married 25 years. Since 1995 his department has been working without a contract. The PBA has been negotiating with the city for three years. I have struggled to maintain the bills as current as possible, by taking cash advances on my credit cards to pay bills and working extra jobs as well to bring in more money. We also gave up a lot as far as vacations and some of life's other luxuries that we were used to enjoying together. However, in October my husband decided to inform me that he no longer wanted to be married and that he no longer loved me. In the interim, I found out he had been seeing another woman for almost a year. I believe he is going through a midlife crises by the way he has been behaving; however, in November his contract was settled and he received a hefty size retroactive paycheck to the tune of $15,000.00. Since that money was earned while we were living together and I was forced to do without many things because we needed desperately to have his raise, am I now entitled to any of that money?

Provided that a Complaint for Divorce has not yet been filed by wither you or your husband, you are certainly entitled to half of that money. Moreover, it would be my position that he is responsible for at least half of the credit card debt resulting from the cash advances. You are absolutely entitled to some of that money. How much of it is subject to negotiation or, if an agreement cannot be reached, then subject to an equitable distribution determination by the Court.
