Legal Question in Family Law in New Jersey

Bigamy

Greetings:

If, in NJ, an applicant for a marriage license swears either,

1. that he/she has never been married, or

2. has been married, but is divorced (NJ does not require documentation proving divorce)

and, in fact, is not divorced for the first spouse, what is the status of the subsequent marriages?

Also, does NJ recognise any sort of ''common law'' divorce. In the case of which I am writing, the spouses never met one another again after the ceremony. The woman married twice more never having been divorced.

Are case of perjury ever prosecueted? What are the penalties for bigamy.

Your help will be more than welcome.

A married person can not marry another person; there is no marriage. New Jersey does not recognize common law marriage

False swearing is a crime. Perjury is prosecuted.
