Birth Certificate Name Changed

Dear Lawguru,

My question is: On May 2, 2001., I birth to my son in the County of Gloucester, state of New Jersey. My husband who is soon to be my ex., signed his name to the birth certificate, he is not the father how can i correct this so that the real father of my son can sign his name and therefore, my child to have his real fathers last name. Also, is there a time limit, or grace period for the correction to be made. Thank you for your time and consideration with matter.

Unless there is consent on the part of your husband (who is now presumed to be the father), the biological father would need to file a Complaint in which he would request a judgment determining the paternity of the child. Eventually, blood will be taken from both men, the child and you to determine who the father really is and a judgment would be entered on that basis. This should be done immediately because as time goes on, the Court may not allow the blood test to even take place. Time is of the essence. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion.
