birth father contesting adoption

About a baby we were going to adopt... birth mother made it very clear she wanted child to be adopted while pregnant. Birth father is now saying he will not sign, he wants to take the baby. He lives in poverty with his parents and no way of supporting himself or the baby. He also messes with drugs and such.

Will a judge take this into account if we take him to court to try and adopt? Birth mother says she will fight for sole custody and raise the baby rather than have him get custody, she fears for the baby's life. In that case we would help raise the baby in question.

I only handle so many adoptions at once, so I would probably have to refer you to another attorney. However, you should really have an attorney for this. It is way too serious not to have one. It sounds like this is going to get messy in a hurry.
