Legal Question in Family Law in New Jersey
my boyfriend has his kids (for unsupervised visitation) 4 days a week, every other week. This is his week with the kids. We are in NJ and were planning on taking the kids to PA for some Christmas things. We may possibly stay overnight since it will be late when we are done and it is a 2 hr drive home.
His ex, who is the custodial parent, is demanding we tell her where we are going and says she has to approve it if we are taking the boys over state lines overnight.
We say, she has no right to 'keep tabs' on us if it is his time with them and they are back for the schuduled drop off time.
Who is right in thhis situation?
Also, she stated that child support does not cover the cost of clothing in NJ. Only food and Shelter. We obviously know she is wrong, but can you verify this also?

Is there a court order in place? If not, there are little to no rules. If there is a court order, it should spell all of this out. I would sit down and speak to an attorney to discuss all of the issues in the case. Child support includes basic needs, such as clothes.
