can my boyfriend legally adopt my kids?

I have been divorced going on 3 years.I have legal sole custody and legal physical custody of my 2 kids. I receive no child support from the father and he was just recently incarcerated. My kids and I have been living with my boyfriend for the past 3 years. He has supported my kids as his own. My kids want to have their last name changed. Is it possible, even though not legally married, that my boyfriend can adopt my son and daughter? Due to the charges that my Ex was sent to prison for I am also trying to find out if this can be done without his consent and have his consent waived. Any advice is greatly appreciated.

Your boyfriend may be able to adopt your children and you do have to obtain your ex-husband's consent or else you are going to have to terminate his parental rights in court. I advise that you see a lawyer regarding this situation.
