Buying him out

I would like to buy my husband out. We have not been together for over 18 months. I have alone been paying the mortgage, and all maintenance. I collect rent from a tenant since I have a two family house. He does pay for child support only out of court for our 3 year old. Was he liable to help me pay for mortgage even though he doesn't live in the matrimonial house as he rents his own apartment. I got him out of the house through a restraining order. Please advise if I buy him out if he indee gets 1/2 of the equity. thanks.

Thank you for your inquiry.

I believe that he should be helping you pay the mortgage even though he is now out of the marital home. Furthermore, in light of your present situation, he may not deserve 1/2 of the equity if he is not contributing towards the mortgage.
