Legal Question in Family Law in New Jersey

Car Insurance and Teen Drivers

Is it true that in New Jersey children of divorced parents, that the parent who signs for the permit and or license is responsible for the car insurance? There is no mention in the divorce decree re: car insurance. The divorce was when the child was an infant. How can you get the other parent to split the cost if they have always claimed poverty and has never split anything. Car Insurance is very expensive for boy teen drivers. Any help will be much appreciated. thank you

Re: Car Insurance and Teen Drivers

The amount of child support can be adjusted based on "substantial change of circumstance". If you are telling me that there has been no change in the amount of support in almost 17 years, then there is no doubt in my mind that there has been such a change. It is certainly time for the parties to revisit the appropriate amount of basic child support that should be paid. Other additional costs (such as car insurance and car related costs) can also be considered. If the partes cannot agree to a new amount, then a Court can determine the issue upon a proper application, made by Motion.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact a Family Law attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. If you call me, mention Law Guru and your first one hour consultation will be free. Good luck! Rob Gleaner

The owner of the car provides car insurance, but the other parent should contribute a reasonable amount.
