Legal Question in Family Law in New Jersey

My chances on keeping my home

I was laid off from my job of ten years almost 4 years ago. My husband and I agreed that I should stay home and raise our son since his salary was enough to support us both. We own a home together and have a six year old son. He decided that he no longer loves me and wants to move out. We have agreed that my son and I would remain in the home so that my son have some security through this ordeal, I don't believe he should be uprooted because his father wants to move on. He knows he will have to help me considerably financially for us to remain here. As I mentioned, I haven't worked in 4 years, although I know I need to find a full time job,I would never make enough that would pay for all the expenses this home requires. I don't know what kind of legal arrangement could be made, but my husband thinks he should remain part owner. My question is ''Would a judge grant me the sole owner of this home even though I would not be able to afford it without alimony from my husband''? I don't want to be obligated to him if he were to remain part owner because he would be paying for some expenses.I don't want to sound greedy, but I would like it to be mine without any strings attached to him.My reason is not the value, but stability for my son.

Re: My chances on keeping my home

I respectfully suggest that you are putting the cart somewhat in front of the horse in asking about the title to the house. You have some real issues concerning an overall resolution of your divorce including issues of child support and alimony, as well as equitable distribution of the marital assets. There are many ways the house issue can be dealt with in a settlement. You really should contact a divorce attorney or two to sit down and discuss the issues.
