Legal Question in Family Law in New Jersey
change in circumstance?
I was divorced 0n 4/04, ex wife was to receive alimony and child support, after 1 year she gave me primary custody of our 2 children and the courts in NJ agreed, I still have to pay her alimony for another 7 years even though I have custody , she is to pay child support for the 2 children at 31 dollars less then her alimony that I send her. My question is why would I have to pay when she does not even bother trying see them, (4 times in 2 years) and she does not even give them anything for the holidays and birthdays. where is the justice in our system? I pay for everything and get nothing. Does any one know if there has been a simular custody/alimony issue that alimony was terminated on this bases, Please let me remind you she works and makes 31,000 a year. She told the court she can only work part time, if that was me the court would tell me get another job.

Re: change in circumstance?
I'm a little confused about your situation. First, alimony has nothing to do with children. Since there is money going both ways, you should really just be paying her $31. If the alimony was based on her only making a certain amount and now she makes much more then now you can go back to court and get it thrown out.
I suggest you meet with an attorney to discuss your matter. My initial consultations are always free, so call me at 732/247/3340 to discuss your case.
