change of circumstance
In 2000 I made 140K from being self employed, this year I have made no money to date 7/01. I paid support & alimony of 2400 from Jan 2001 to March 2001. I notified my ex wifes attorney of my unfortunate change in income asking to accrue my payments until Sept 2001. They refused and filed a motion for immediate payment. In the meantime my house is in foreclosure and up for sale I produced these documents along with financials from the business stating zero income in 2001. The judge ruled in their favor for me to pay within 30 days. Can I now file a change of circumstance?

Procedurally, I'm not quite sure what occurred when you were before the Judge on the enforcement hearing. If the facts and circumstances were truly as dire as you have painted, I am surprised that the motion came out the way that it did. Perhaps the Judge did not believe that your situation was permanent or did not get the true picture. Another possibility is that he had no motion in front of him arguing change of circumstance. In other words, you may have only been on defense and not on offense. The bottom line is that you need someone to look at the entire picture and then come to a course of action. This advice is based purely on the little bit of information that you have given to me. There appear to be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained.
