Change in circumstances

My husband and his ex were divorced almost 6 years ago. She got sole custody because he never showed up in court. She now works the overnight shift. The kids (now 10 & 7) were staying with us while she worked, but on a whim she changed her mind and they now stay with a babysitter. We believe she also makes quite a bit more than my husband now. We are considering going to court for a modification of the divorce decree. We don't have a lot of money for a lawyer, but want to know if there's a chance a judge will agree they should be with their dad?
