Legal Question in Family Law in New Jersey
Name Change
I am getting a divorce pro se using a kit. The case has been listed for trial already and I just found out that the fact that I want to restore my former name needed to be in the complaint. How do I go about getting this into the judgement for divorce?

Re: Name Change
It depends on the Judge. Some would require you to amend the Complaint, asking for that relief. Others would allow you to simply ask for that relief at the time of the trial. In the latter case, you will have needed to notify your spouse of the fact that you will be requesting that. Notification should be in advance (at least 10 days prior to trial). You should call the Judge's law clerk to seek his/her advice as to that Judge's procedural requirement. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, before you take any further action, you should contact an attorney (either me or someone else) to discuss your matter in more detail. Only then will you be able to rely on the advice. I will be happy to assist you. However, you need to call me at 856-546-8010. If you mention LawGuru, there will be no charge for your first consultation. Good luck! Rob Gleaner
