Legal Question in Family Law in New Jersey

name change of a minor

My ex daughter-in-law is trying to change my grandsons last name to her new married last name , with the premise that he is embarressed at school because his mothers name is now not his last name! Can this be done without my sons approval or even if he approves do I have any rights to try and stop any type of court order!! The boy is only 7 years old and my son is afraid if he doesn't ok this that his son will be very upset and he will be under constant pressure from his mother to beg or whatever he needs to do to get his fathers consent. Also if it must be done legally would my son still be obligated to pay child support or can he use this as a possible deterent??

Re: name change of a minor

If your son formally objects in court to the name

change it probably will not happen.

In this day and age the children of divorce parents are common and the name difference is not

uncommon.

So long as your son remains the legal parent of his children his support obligation remains. Adopation by another man terminates your sons parental rights and responsibilities.

I would suggest that you obtain the services of a

child psychologist to rebut the name difference is somehow injurious to the children.
