Legal Question in Family Law in New Jersey

Change in Providing Support

I have been paying child support since 7/99. I have paid my ex direct based on the courts ruling. We never set up parental visitation. I always have my 2 children every other weekend, some holidays and any other special occasions. After 3 years my ex is suing me for more support. No problem there. I know it will increase. Can she partition the court to have it taken out of my pay and/or set up a set schedule of visitation after 3 years?? I have never missed a payment of support.

Re: Change in Providing Support

Under federal law yourformer spouse can elect direct payments or a wage execution. It is her choice. Even with a schedule set by court order you are entitled to equal time with your child.
