can I change venue if a motion is pending?
The ex has no custody or visitation;
there are substantial reports and
psych evals stating he abused the
children. The court required
independent psych evals and then
didn't require them to be written (He
paid over $10,000 to his
psychologist.) The case was a
disaster with every issue. Now he is
stating he has had no idea whether
the children were in college or not...
but I have an email he sent to my
son's college email in 11/07. Also,
because of the abuse, my daughter
has been staying with friends but
using my medical, dental, has been
on my car insurance, etc. The ex
wants back child support (even when
they were with me) and wants to
emancipation them. The have LOTS
of problems. I would like to be sure
that I have a non-partial judge.
Can I get a change of venue, and
have a motion heard in my new
county, if a motion has already been
filed in the county where the divorce
was granted?

First of all, in what county is the motion filed? Is this the first postjusgment motion? I ask this question because in most counties the judge who hears motions after a divorce judgment is entered is not the same judge who heard the divorce.
A change of venue may not result in your getting a judge who will agree with you.
