Legal Question in Family Law in New Jersey
change of venue from nj-pa
my ex wife moved form nj to pa. she notified me in writing and i agreed (september 2003). now after a family argument (between ex wife and new wife) she has petitioned the courts to change jurisdiction form nj to pa. i petiotioned to move from one county to another w/in nj. now i'm told the statute of limitations has run out-i can't change the jurisdiction and she holds all the power with respect to changing the child support jurisdiction to pa over 6 months since they moved). i tried to be the ''nice guy'' and let her go amicably. there is no parenting/ visitation/ or custody order, and i do not want to pursue one. the children are old enough to make up their own minds. what are my chances of retaining jurisdiction on this case by pursuing the change of venue within my own state, or is it hopeless?

Re: change of venue from nj-pa
You are not clear in terms of what has been filed thus far. However, you may actually do better allowing this matter to be heard in PA. I believe the Child Support Guidelines are higher in NJ, but I am not 100% positive of that. I am certain that you will fair better on the issue of alimony in PA, if that is an issue. I suggest that you consult with an attorney who practices in both PA and NJ who can compare your rights in both states for you. If you would to be referred to such an attorney, please contact me.
