changing childs last name

My husband has a daughter in NJ we live in CA. The child has his last name and now since the mother is mad we got married she states she legally changed the child's last name to her's even though he pays child support and sends gifts can she do that without telling him the name was going to be changed

It is very unlikely that the child's mother went to Court and got a name change. She should not do this, of course: determining whether it will hurt or help the child to change the child's name is likely to be something that a Court will want to decide.

A motion can be filed to vacate the name change because there was no notice to the child's father as to the

name change proceeding.
