Legal Question in Family Law in New Jersey

Child Care

I am divorcing, moving to a new location within the state, and I have selected a child care provider/housekeeper who is male, certified, and an experienced teacher with young children. He brings excellent references and I feel extremely confortable having him watch my 3 girls ages 3, 4, and 7.

My soon to be ex opposes this soley because he is male (and according to him, could molest them) -- as if a female couldn't.

I feel that he is using this to make it a harder transition for me -- I will have physical custody -- what rights do i have to make this decision regarding choosing the best provider?

You seem to have made an effort to hire someone who has the abilities and

references which give you confidence. You should ask the father if he has found a female care give with similar qualifications. That will afford him the opportunity to participate in the

selection of a caregiver, which he will surely fail. Give him a couple of weeks to find this person.

I believe that the Court would support your selection if it came to

a decision by a judge.

Here's the more important question, who is your attorney? He or she should be able to answer this for you. Who has custody? If there is no court order then the children can be really used as pawns here. For example, without any court order, he can refuse to give the children back after visitation. I had a case like that last week.

Bottom line is, without a court order, chaos can and usually does happen. While I think mediation is a better answer, you at least need some type of order setting the ground rules, even if its a consent order between the two of you.

Thus, I strongly suggest you consult with an attorney before this gets any worse.

I have read what the other two attorneys have written, and as usual Gary and Jef are right on.

You should have an attorney. Yes, it is expensive, but you need that assistance. You want to make sure that your life and especially the girls' lives, are not plagued by little and big problems arising from the divorce. And money is a huge issue, with children that young. You need to spend the money on a competent divorce attorney.
