When may a child choose thier residence

My fiance is going thru a divorce. The man has a daughter from a previous marriage. The biological mother has court custody, but the daughter is living with the father because the mother is an alcoholic. The father is mentally and emotionally abusive. We would like the daughter, who is 15, to come and live with us. The parents will not agree to this. What options do we have?

You question is a little confusing because you have stated the daughter is with the father. I assume you mean her stepfather. In any event, custody can be sought when the person with custody is abusing a child. You should call me at 8002737933 to discuss this matter futher.

If your fiance is the natural father of this child, and the allegations that you have raised can be proven, he should'nt have too much difficulty in convincing a court with proper jurisdiction over the matter to rule that it's in the child's best interests to be with him.
