Legal Question in Family Law in New Jersey

Child Custody and ADD/Tourette Medication

I am divorsed and my ex-wife has a physical custody of our son, who is diagnosed with Attention Deficite Disorder and Tourette Syndrome and therefore is administered (by his physician) some SSRI drugs, such as Paxil(he has also been on Luvox, Ritalin, etc...) I am disputing the dose and even the very fact that he is being administered these drugs, but the 'official' point of view of MDs and the school prevails. What are my rights as another legal custodian parent as far as deciding on the dose and the type of the medication for our son? Whom will the judge most likely side with in this situation? Do I have a right to forbid to administer the drugs to our son?

Re: Child Custody and ADD/Tourette Medication

Assuming that you have joint legal custody over the child, you certainly have an equal say as to medical decisions regarding your child. Whether or not you would be able to prevent the administration of drugs to the child depends upon the specific facts involved in your situation. Accordingly, please feel free to contact my office at 732-246-0909 to discuss further.
