My ex boyfriend and I are in mediation right now trying to work out agreements about our unborn son. He is threatening to cut off mediation and take me to court for custody. My question is if we go to court and I want a psychological evaluation done of my ex can I also ask that one be done of anyone my son might live with? My ex lives with another unmarried couple, their infant son and his three daughters in a two bedroom house that is converted to a three bedroom. My ex also just got engaged to a woman he has known for 3 months that has a 17 year old who is having behavioral issues and a 12 year old authistic child. I know that I will be subjecting myself to the evaluation and my parents and sister since if my son lives with us we should also be evaluated. But can I mandate that anyone my son lives with has to go through an evaluation to make sure my son is safe in that living condition?

It would help to know how you ended up in a mediation and whether it is Court ordered. It is extremely unlikely that a Court would take a newborn from the birth mother, so you really should hire an attorney so the issues you raise can be presented in proper form to a Court. You must lay a factual basis for an evaluation to be ordered.
