Legal Question in Family Law in New Jersey

Child Custody Change

My husband has 3 children, ages 20, 17, and 15. He has primary custody. The 15 year old spent a month at her mothers and now refuses to come home. She wants to live with her mother. Can my husband make her come home or does she have a right to stay at her mom's?

Re: Child Custody Change

The only way she can say at her mom's is by court order. Otherwise, the police will help him.

Re: Child Custody Change

The Court Order controls, and the Mother had best return the child immediately or she may face Court santions or even a kidnapping charge.

Who is your husband's lawyer? Given that school is fast approaching, this case needs immediate attention. Please feel free to contact me to discuss this further.

Re: Child Custody Change

the custody order must be followed and if father is supposed to have custody but child refuses to return, then mother is in contempt of court. father can file a petition for contempt. if no order is entered for custody, then i highly recommend father to file for one. Please feel free to contact my office for a free consultation.
