Legal Question in Family Law in New Jersey

Child Custody

My girlfriend & I have broken up. We have a 4 month old child. Can she automatically make visitation rules? She wants to allow me every other weekend only! Or must we go to court to have judge decide? Also baby & mom live in NJ but I live in NYC.

If you and the mother cannot reach an amicable solution, then you should let the court decide.

You need to act immediately. The longer you wait, without visiting, the harder it will be to get parenting time. I sugguest you file immediately for custody and parenting time. If can always resolve later by agreement, and the Courts have mediation.

She does not get to make the rules.

Without a court order, its like the Wild West; there are no rules. That is why the Family Part of NJ's courts are very, very busy. If you guys can agree, then great. But it seems like you can't so you'll have to go to court. Call me at 732/247/3340 to discuss this further.
