Legal Question in Family Law in New Jersey

where child custody issues should be heard

I have 2 children from a previous marriage. My ex-wife resides in Bergen County NJ she had custody of both children until recently & all modifications to our case were always heard in Bergen County. I was just recently granted legal custody of one of my children. I reside in Ocean County NJ, since I am the legal custodian of my one child when I file a modification regarding that child, which county do I file in? The county I reside in (Ocean) or the county my ex-wife resides in (Bergen)?

Re: where child custody issues should be heard

You should file in Bergen County because the case started there and another child or other children reside there. It makes no sense that there should be one judge regarding your other children and another regarding the child who is residing with you.
