Legal Question in Family Law in New Jersey
child custody
is there a legal age when a child can decide if they want to have overnight visits with a non-custodial parent? if so what is that age?

Re: child custody
There is no set age, but, generally, the older the child, the more weight the Court puts on their opinions. There are always other factors involved.
If you want to discuss this in detail, get back in touch. I practice throughout Southern New Jersey.

Re: child custody
not really a legal age other then 18 but a parent can petition to modify custody anytime and request the court (meaning the judge) to speak to the child to see what he wants. Based on age, intelligence and the court's impression of the child, the judge will make any modifications he/she sees fit for the child's best interests! call my office for a free consultation on filing a petition to modify custody if you are interested!
