Child custody non-married couple

Mother and father not married. Father admits paternity and has been paying $1000 per month child support voluntarily (without paperwork) for all 4 years of child's life. Child has been living with mother and grandmother since birth. Father now retained atty to seek sole physical custody. Mother is waitress and works evenings while granmother cares for child. Plaintiff atty has been directly contacting mother by phone asking questions. She is unrepresented by counsel and has moderate English skills. Has modest income and is frightened.
