Child Custody
I have a pending case forchild support and custody of my two children. My ex always records our conversations without telling me, he threatens to ask that the state take my children, he lied and said he was homeless to get our daye postponed. He collects unemployment and pays child support for his other child. He does drugs on a daily basis. He tells me that because I suffered form depression at point, that I am going to loose my kids. He called the cops after he found out I filed for support and told them that he was concerned for my wellfare, the cops came and said that they were sorry to waste my time, vecause they could see nothing was wrong with me or my children. What am I up against? They want us to see a mediator, but I want to just see a judge and have him pay through probabtion. Is this something I can ask for? He also tried to say I won't let him see his kids, because he called 2 hours after the time agreed upon and I had things to do and was out when he finally called. Can this be used against me?

You need a divorce attorney. What you describe is horrible, and a lawyer should be able to cut through a lot of this and get you in front of a judge to get an Order setting child support and visitation limits.
You likely have limited finances. A divorce attorney is still really, really worth your money.
You will be in the courthouse in Paterson. Every judge there will be very fair with you, in my experience. You just need to push it through and get your day in Court.

I assume you can't afford an attorney. Your best bet is to get one. Did you call legal services?

You appear to be appearing in court without an attorney. You need to hire an attorney. Once the judge has a clear understanding for your actions you should not have a problem.

there are a few ways to fight these type of accusations. first of all, most custody battles get ugly so judges know the tactics one side may use over the other such as you described. there are ways to PROVE your case and even better, to disprove his! i would have to spend 20 minutes chatting with you to give you some pointers, so feel free to call. no consultation charges at this firm!
