Child Custody

My 6 year old daughter has lived with me all her life. I've been the only parent taking care of her physically and financially. I went to file for child support & sole custody of her as as soon as her father found out he wants to fight me for custody.( her father & I have never been married) I live in New jersey & he lives in Georgia.(which he moved to when she was 2 years old) Her father has a criminal record and a few outstanding warrants. What are the chances that I will get full , sole custody of her?

based on what you have said, and so long as there are no reasons why you would be a risk to the children, then I agree that the chances are very very very good that the kids will stay with the parent who has raised them safely and well up to this point.

He has been in jail? He lives over 800 miles from the home that they have lived in all their lives? these are factors AGAINST him in a custody fight.

In a court hearing, the Judge would do what is in the 'best interests of the children', what is best for the kids. the Judge would want to know how the kids are doing in your care, whether there are any problems with the kids, and many other factors affecting them, before deciding custody.

I have seen quite a few cases like this, where the children's father tries to use the threat of a custody fight to get out of paying child support. Do not put up with this gentleman doing that.

It depends on a variety of factors. I'm not as optimistic as the other attorneys but that may be because I have been in front of some "different" judges. However, you do have a good chance with just those facts you gave me. I would need more info before I gave you a better answer as family law is a very complex area of the law and there are always a lot of issues and factors for each case.
