Legal Question in Family Law in New Jersey

child custody/relocation

My child is 11. I am now married with 2 other children. I filed a motion for relocation. I moved to NY 3 years ago. Her father lives in NJ. I have a job waiting for me in another state (FL), where the cost of living is also less expensive. He is now threatening custody and claims my child will benefit from living with him. (he is not remarried and does not have other children) I can not afford to retain an attorney. What are the chances I will lose my daughter, what are my chances for the relocation?? Please Help!!

First, what state are we in here? If you moved to NY and you have the child, you should be litigating in NY. Second, I do not have any facts here so there is no way I can really give you a good answer. However, I can tell you that he will have an uphill battle to get custody while you may have an uphill battle to move. Finally, how do you know that you cannot afford an attorney?

I agree with Jef. NY is the proper state for him to file in. You both face uphill battles.

If it turns out however that you cannot afford an attorney, you can contact the county Bar Association to see if they have a Pro Bono Panel or you can contact Brooklyn, St Johns and CUNY law Schools to see if they have a family law clinic that will take you on for free or for a reduced rate. Hofstra also has a clinic as do the Manhattan law schools. Check them out.
