Legal Question in Family Law in New Jersey

Child living at college-am I still entitled to child support

My daughter will be going off to college for first time. She will be home every weekend, for three weeks during Christmas, a week in the spring and at least three months in summer. Am i entitled to child support during that time and how do I go about making sure that I get it if it comes through probate if I am

entitled.

hi - unless there's a court order terminating the child support due to her emancipation, you should still be entitled to it. a lot would depend on how your divorce judgment is worded. another factor is if your ex pays towards college, as well as child support. feel free to call me at 609 263-0089 if you have any questions.

When a child goes to college this is a substantial change of circumstance that will usually dictate a change in the child support amount. There are numerous factors that would go into the equation, such as the cost of college, other contributions being made by the parents and the comparative incomes of the parties. You need to immediately seek the advice of an attorney to review your situation. I would be happy to assist you if you call me at 856-546-8010.
