Legal Question in Family Law in New Jersey
The child isn't mines :(
Found out my 7 year old son from my ex wife is not my child with an at home DNA kit. He lives with his mother and her new husband of 2 years in Conneticut. He calls both of us daddy and I have paid child support from day 1. I am in Active Duty in the Navy (and was away when she told me she was pregnant). She filed for divorce citing irreconcilable differences years ago. I'm on my way to Cuba in 2 weeks. I don't know what to do. Do I contact her and tell her that I know or go straight to a lawyer? I don't feel I should have to pay her child support anymore. I am EXTREMELY UPSET. She gives me HELL to see my son and now I know why.
please advise...

Step 1 visit a lawyer.
What state is the support order from?
Take all the evidence that you have to the attorney so that an appropriate strategy can be developed.
No need to tell your ex what you know until after you have had a legal consultation
Good luck to you and if we can help contact us.
Re: The child isn't mines :(
You need immediate assistance from an attorney. Say nothing to your ex at this point. An application needs to be made to the Court to resolve this quickly.
Keep in mind that this advice is based purely on the little bit ofinformation that you have given to me. There certainly may be other facts that would change my opinion. And, no one can rely on the opinion of an attorney who has not been retained. Before you do anything, you should consult with an attorney. I would be happy to discuss this matter with you if you would call me. Mention Law Guru and your first one hour consultation is free. Good luck! Rob Gleaner

You will have to file a motion to have a dna test done which the Court will recognize and once the child is determined not to be yours your child support obligation to the child will end.
We can do everything using computers and fax machine to file papers with the Court.
Call me if you like.

I suggest you act ASAP before this drags on and you have to pay more money. I have an office in Toms River which is not too far from Moorestown, so feel free to give me a call to discuss your case. My initial consultations are always free.
