Legal Question in Family Law in New Jersey

child neglect

my ex girlfriend has custody of our son. My mother saw flies all over the apt. I was over there and saw that the apt. is infested with flies I assume from a rabbit that is housed in my 5 year old son's room. I mean INFESTED all over all of the walls and in the air. We asked her to clean but to no avail. What can I do? Can I do anything legal if necessary. I don't want my son to become ill or anything. Also, the apt. is filthy.

Please help with an answer soon. I live with my parents who are both home in a large clean home.

I have joint legal custody.

this kind of situation is always difficult. Much depends on the facts of the particular situation.

you have some options, including filing a motion to ask the Court to give you custody. Not easy to persuade the Judge that the child would be better with you.

Calling DYFS is something you should be very careful about: do not call DYFS unless there is a serious risk of harm to the child, not just a disagreement or little difficulty.

But you should not do Nothing if your child is at risk.

Much better to get some legal advice, and act carefully.
