Legal Question in Family Law in New Jersey
Child support and age of choice.
I have been divorced for 5 years. My 13 year old daughter lives with my ex-wife. I religiously pay my monthly child support, but my ex says that she has no money to buy our daughter clothes. Are there any laws that state how child support money is to be spent? Is there any way I can find out where the money is going?
I would also like to know at what age the minor child can choose which parent they want to live with.

Re: Child support and age of choice.
The Court assumes that the money is being spent by the parent appropriately. If you feel that the child is not being cared for appropriately, you could challenge same through Court motion. However, you should know up front that it will be very difficult to prove. There is no particular age that a child can choose; the Court is basically guided by the age and maturity of the child, if there is an unbiased opinion expressed without undue influence from one parent or the other. You should immediately seek the advice of an attorney, who will discuss the totality of the circumstances with you and make a determination as to the direction in which to proceed.
