Legal Question in Family Law in New Jersey
Is child support only based on one job?
I have sole custody of my 2 children. At the time of the custody hearing (3 years ago), my spouse had one full-time job and the decision on the amount of child support was based on that one job. She now has a different full-time job where she is making more money than her previous full-time employment PLUS she has an additional TWO part-time jobs tacking on another 20-25 hours per week. Do I have the right to bring her back to court to re-calculate the child support based on all THREE of these jobs? If not, can I at least get her on her new full-time employment? I thought I read somewhere that child support is based on your main source of income ONLY while the rest cannot be touched. Please advise.

Child support is based on ALL income. You should have a lawyer assisting you.

Re: Is child support only based on one job?
No, CS is based on gross income. Thus, if she is making more money regardless of how many jobs she has, then you can get the CS recalculated. While this is something you can easily do yourself, I would suggest getting an attorney because I have seen way too many calculations done wrong. My initial consultations are always free, so call me at 732/247/3340 and we can discuss your case. Then you can decide if you need an attorney.
Good luck!

The child support guidelines were recently amended. I would be happy to look at the prior order and compare it to her current income, which includes all income.
