Child support
hi, i have three childen under 18. One is a full-time college student. I make more money than my husband. The question is, if we divorce, is he responsible for any child support payments, or because I make more money, he would be exempt from paying any? I have a small business.

There are numerous factors that play into the calculation of child support including, among others, which parent is designated the parent of primary residence, how much time each parent spends with the children, the incomes of each parent and the applicable deductions. Unless parents have unusually high incomes or certain other unique circumstances, child support is calculated using a computer program that considers all the appropriate factors to compute the amount of child support based on the statutory guidelines. This can be done manually using a form as well. If one parent is designated the parent of primary residence, the other parent typically is responsible for some child support, the actual amount determined using the above software and guidelines.

Wow! you need to have an smart attorney tell you a bit about divorce law! Yes, he will have to support his children, and yes he will have to contribute to the cost of college.
From what you have said, it seems very likely that you are going to have to start a divorce. You need to solve some problems in your life and your children's lives, and a divorce is pretty much needed; that is what I understand that you are saying.
Employment, income to pay the family's expenses, is an issue.
You have kids: custody and vistation, and child support are issues.
Child support and college tuition needs to be paid. Measured in tens of thousand of dollars.
You probably have a house and some money saved. You probably have a pension plan; maybe your spouse has a pension plan.
You need to see a decent, experienced divorce attorney located reasonably near you, and have the attorney to review your situation carefully with you, and give you some guidance. A good attorney could save you thousands of dollars and a great deal of heartache, make your life more manageable, and reduce the harm to the kids. He has to pay in accordance with the child support guidelines. He pays in accordance with his ability. What you earn does not matter.
