Legal Question in Family Law in New Jersey

child support and college forever?

Brief history -- my husband has 21 1/2 year old son, divorced from mom for 21 years. Orig. agreement had no mention of college. Dad has never missed CS in all yrs. - child entered college, mom had agreement drawn up that dad would pay 65% of college for 4 years and she would not ask for any increase in child support, dad agreed. Year and 1/2 later, mom takes dad back to court to have her original agreement thrown out and increased child support and full college costs! Gets over 300. month CS increase (yes, increase) but only 63% of college, no mention of time frame for college in this agreement. Now, just when almost 'paid up', get letter that 'child' does not have enough credits to graduate in June -- will have to go another semester -- to expect the bill. Now, 'child' does not work, lives at home, tuition paid was enough to pay for credit fulfillment for an on-time graduation. Dad feels it was done purposely to extend the $ coming in for a 'child' who has nothing to do with him - hasn't ever -- only good for $ and if he obviously deliberately did not take enough credits to graduate 'on time', does dad have any recourse? Or can they drag this out forever?

Four years of college is the limit. There are students who take six years to complete college.
