Legal Question in Family Law in New Jersey

Child support & college

Husband's divorce decree has no mention re: college only states both parties shall confer on health, welfare and education. They have joint custody with mother having physical and residential custody. The mother has always claimed poverty she did not work until the child was in 4th grade. At that time she took a teacher's aide job. Child is now a junior in high school and she is only making $15,000.00 a year. She never works in the summer. Before she had child she was a secretary. Is there a way to prove she has purposley under employeed herself? When child was going from 5th grade to 6th she served us papers saying she wanted to move out-of-state. Through attorney litigation my husband agreed to an extra $100.00 per week above child support guidlines and quite a few extras. Did not want to put child in the middle. At this mediation she claimed she was supsose to be a housewife when our attorney kept asking her why she did not have a full time job. She works 9 months a year 30 hours a week. Our attoney said she was tough. Now, we are facing college of which she says she does not care, she is not paying. Mind you she has never paid anything. How do you make someone pay their fare share? agreement made is open ended.

Re: Child support & college

It all depends on what work the mother is qualified for. If she should be earning more she can be compelled to do exactly that to pay for college.
