Legal Question in Family Law in New Jersey
Child Support for child over 18 and in college
I have paid child support for the past 16 years and my child is now in college and my ex and I are each paying 50% for both tuition and room & board. My ex is still looking for child support even though he is 200 miles away. When my child came home on break, he stayed with me the entire weekend because the room that my ex formerly provided was being used for another purpose.
Is there a way that I can protest the child support because I believe that it is unjust as I continue to provide a room in my home, my childs vehicle, and I purchase his clothing.
Prior to going to college, my child spent nearly 40% of the time at my home and spent most of the summer with me as my ex would spend summers at a beach house.

You seem to have a basis for modifiying the child support. You would file a motion (a written request) with the Court asking for this.
You are likely to be more successful with an attorney representing you.

You should be paying chid support calculated by multiplying your weekly obligation times the number of weeks he
is actually with his mother and then dividing this number by 52.
Call me if you like.

Just wanted to second what the other attorneys said. An attorney would go a long way in helping you, but it might not make sense to hire one if it will cost you more than you will save.
