Child Support and College Room and Board

I am paying $325/week child support for three children. I am also required to pay 60% of tuition and books. The eldest plans to attend an out of state school in september charging $2750/semester for room and board. The divorce order is silent on "room and board" expenses. My exwife feels that I should pay 60% of the room and board costs while I feel that my child support payments should cover my obligation for room and board costs.

The timing of the divorce decree is crucial. Depending on when the child support was set, you may have a right to have a new determination because you should be able to show a substantial change of circumstance. A careful review of the separation agreement or Court Order, whichever is applicable is crucial before a proper answer can be given to you.
