Child Support for College Student

My ex-husband & I currently have an active Child Support Order for our children, ages 16 & 19. We have joint custody, but the children have always resided with me. Our 19 yr old daughter is a full time college student, lives at home, and has a part-time job. My ex-husband is threatening to take me back to court, because he doesn't want to pay child support for our 19 yr old, during the summer months because she doesn't have classes. Can he do this? Our daughter still lives at home and only has a part-time job. She is not financially independant and will be returning to a full time college schedule in the fall.

Hi,

He can file a motion. Howeve, if she truly is taking 12 credits a semester, and is only working part time, and still resides at your home she is not emancipated and you are entitled to receive child support.
