Legal Question in Family Law in New Jersey

child support vs college tuition

My son has been offered a student loan to attend college in New Jersey (where he resides), my ex wife turned down the loan and expects me to pay the entire tuition amount. Do I legally have to do that? Can she legally do that? I will also still be paying child support during his college years.

Re: child support vs college tuition

I cannot give you a good answer based on the information that you have supplied. The answer would vary based on the wording in the Separation Agreement or the Final Divorce Decree. Also, you may or may not be required to continue to pay child support based on many factors; the primary consideration would be whether or not there has been a substantial change in circumstance. In any case, if you want me to assist you, feel free to call my office at 609-546-8010. Good luck!
