Legal Question in Family Law in New Jersey

is my child support contract legal in a court of law?

My friend has signed a contract with the father of her baby stating the amount of child support he would pay her every month. They signed the contract in front of a person who can legally notarize documents such as that and had the document notarized. The document was notarized in New Jersey. Is that contract legal in a court of law in New Jersey?

Re: is my child support contract legal in a court of law?

Any agreement is enforceable if it can be proven in Court. This is true for oral as well as written contracts, notarized or not. However, with regard to all agreements to pay child support, same can be adjusted or even negated based on a substantial change in circumstance and further based on the best interest of the child. You should have your friend consult with an attorney to be sure her rights are protected. If she wants to speak with me, she can call me at 609-546-8010. Good Luck!
