Child Support

If I have a court order for child support, and the childs father has another baby, will my support be lowered?

Arguably yes. But it is a decision that needs to be made by a support magistrate.

I have seen it go both ways. On one hand the father should be responsible for his child with you but he could argue that the new child was an unforseen change of circumstance that dramatically altered his financial position.

Assuming that the father's income has not increased his support payments for your child will be reduced, by five to ten dollars. Your child stills needs to live.

As you have been told, the support might be reduced. However, the Court must do what is called an ODD calculation to determine the proper amount of the reduction. It is very important to include the income of the mother of this child to get the proper amount (it will make the reduction less).
